The terms that govern your use of the Redox Smart Pen website and the prescriber access request process.

1. Agreement to these terms

These Terms of Use (the "Terms") are an agreement between you and Redox Medical Group, 9100 Wilshire Blvd. Ste. 700W, Beverly Hills, California 90212 ("Redox", "we", "us" or "our") and govern your access to and use of the website at redoxpen.com (the "Site"), including the prescriber access request and waitlist form. By accessing the Site or submitting the form you accept these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

We may revise these Terms at any time by posting an updated version on this page with a new effective date. Changes take effect when posted, and your continued use of the Site after that date constitutes acceptance of the revised Terms.

2. Who may use the Site

The Site and the Redox Smart Pen programme are intended for healthcare practitioners who hold a current licence to prescribe in the United States, and for members of their practice acting on their behalf. You must be at least eighteen years old, or the age of majority in your state of residence if higher, to use the Site. By submitting the access request form you represent that the information you provide is accurate and complete, that you are a licensed practitioner or are acting with the authority of one, and that you will keep your submission details up to date.

Redox may verify your credentials with state licensing boards or other public sources and may decline, suspend or revoke access at its sole discretion, including where it cannot confirm licensure or where the programme has reached capacity.

3. Access requests and the waitlist

Access to the Redox Smart Pen is limited. Submitting an access request or joining the waitlist does not create a contract for supply, does not guarantee that you will be offered access, and does not reserve any quantity of product. When access is available we will contact you using the details you provided to explain the enrolment process, which is governed by separate written agreements between you, Redox and the dispensing pharmacy. Position on the waitlist is determined by the order in which complete submissions are received and by our assessment of eligibility.

4. The Site is informational

Content on the Site describes the Redox Smart Pen delivery system and the formulations with which it may be prescribed. It is provided for the information of healthcare practitioners and is not an offer to sell, a solicitation to purchase, or a recommendation to prescribe any product. Nothing on the Site is medical advice, and nothing on the Site creates a physician-patient relationship. Practitioners remain solely responsible for their own clinical judgement, for compliance with the laws and professional standards that apply to them, and for the care of their patients. 5. Regulatory status of the formulations

BPC-157 and TB-500 are not approved by the United States Food and Drug Administration for the treatment of any condition. They are compounded by a pharmacy licensed under section 503A of the Federal Food, Drug, and Cosmetic Act only pursuant to a valid prescription written by a licensed practitioner for an individual patient. NAD+ formulations are likewise compounded for individual patients on prescription. Redox does not manufacture, compound or dispense any drug and makes no claim regarding the safety or efficacy of any compounded preparation. Availability of any formulation is subject to federal and state law, to the policies of the dispensing pharmacy, and to change without notice.

6. Intellectual property

The Site and everything on it, including text, graphics, photographs, logos, the Redox name and mark, the Redox Smart Pen name, page layouts and underlying code, are owned by Redox or its licensors and are protected by copyright, trademark and other laws. You may view and print pages from the Site for your own professional reference. You may not copy, modify, distribute, publish, sell, create derivative works from, or otherwise exploit any part of the Site without our prior written permission. The MEDIVIVE name and mark belong to their owner and are used with permission.

7. Acceptable use

You agree not to: use the Site for any unlawful purpose or in violation of any professional obligation; submit false, misleading or fraudulent information; submit patient health information through the form; attempt to gain unauthorised access to the Site, its servers or any connected system; use automated tools to scrape, harvest or submit information; interfere with the operation or security of the Site; or use the Site to transmit malicious code. We may investigate violations and take any action we consider appropriate, including refusing access and reporting conduct to law enforcement.

8. Third-party websites and services

The Site may contain links to websites or services operated by third parties, including regulators and partner organisations. Those links are provided for convenience. We do not control and are not responsible for the content, availability, privacy practices or terms of third-party sites, and a link does not imply endorsement.

9. Disclaimer of warranties

The Site and its content are provided "as is" and "as available". To the fullest extent permitted by law, Redox disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Site will be uninterrupted, timely, secure or error-free, or that its content is accurate, complete or current. Information on the Site may be changed or withdrawn at any time without notice.

10. Limitation of liability

To the fullest extent permitted by law, Redox and its officers, directors, employees, contractors, partners and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of or inability to use the Site, whether based in contract, tort, negligence, strict liability or any other theory, even if advised of the possibility of such damages. Our total liability for all claims relating to the Site will not exceed one hundred United States dollars. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.

11. Indemnification

You agree to defend, indemnify and hold harmless Redox and the persons listed in section 10 from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or relating to your use of the Site, your submission, your breach of these Terms, or your violation of any law or of the rights of a third party.

12. Governing law and disputes

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of California and the federal laws of the United States, without regard to conflict-of-law rules. You agree that the state and federal courts located in Los Angeles County, California have exclusive jurisdiction over any such dispute and you consent to personal jurisdiction in those courts. Before starting formal proceedings, you agree to contact us at [email protected] and to try in good faith to resolve the dispute informally for at least thirty days. Nothing in this section prevents either party from seeking injunctive relief to protect intellectual property or confidential information.

13. General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor to our business. These Terms, together with the Privacy Policy and the Medical Disclaimer, are the entire agreement between you and Redox regarding the Site and supersede any prior understanding regarding the Site. For licensed prescribers only. This site is intended solely for healthcare professionals licensed to prescribe in the United States. It is not directed to patients or the general public. Nothing on this site is patient-facing advertising.

Not FDA approved. The Redox Smart Pen is a compounded preparation. Compounded drug preparations are not FDA approved. FDA does not review compounded preparations for safety, effectiveness, or manufacturing quality. The active ingredients described here are not approved by FDA for the uses discussed, and no statement on this site should be read as a claim that any preparation is safe or effective for any condition.

Prescription and dispensing. Any preparation described here would be compounded and dispensed by an independently licensed 503A compounding pharmacy pursuant to a valid prescription for an individually identified patient, based on the prescriber's independent clinical judgment and an established prescriber-patient relationship. Availability is subject to applicable federal and state law, including the status of each ingredient under Section 503A of the Federal Food, Drug, and Cosmetic Act, and may change without notice.

Registration of interest only. Submitting this form registers your interest. It is not an order, a prescription, a purchase commitment, or an offer to sell, and it creates no obligation on either party.

Information only. Content on this site is provided for professional informational purposes and is not medical advice. Prescribers are responsible for evaluating the appropriateness of any therapy for a given patient, for informed consent, and for compliance with all applicable federal and state law, board rules, and professional standards.
